If the mortgage is in spouse name and not mine ..What happens...Someone told me the deed is still in my name not to worry if the mortgage is in his name...Is this true?

Am I intitled to half still? If his 401 k is in his name only at work.Do I get half?

The real paper is the deed. Make sure your name is on that. That's the document that verifies you as partial owner of the property. His name would only be on his 401K . You can still get something (depending on how long you have been married) but half may be a little much.
