What is the name of your state? MN

How much notice does a landlord have to give a tenant if the landlord wants the tenant to move out? There is no lease agreement. Rent has been paid timely each month and has been paid up for the month of May. The landlord has told the tenant he has 1 week to move out of the home.

I believe since the tenant has paid rent for the month of May, the landlord has to provide a 30 day vacate notice, which means the tenant would be required to move out by the end of June because the 30 day notice starts at the end of May/beginning of June. Is that correct? If not, what are the tenants rights in the situation.

Minnesota Statute 504B.135 TERMINATING TENANCY AT WILL.
(a) A tenancy at will may be terminated by either party by giving notice in writing. The
time of the notice must be at least as long as the interval between the time rent is due or three months, whichever is less.

I'm not a lawyer, but I think this would apply in your case. Unless you agree to move out early you have 30 days from when they provide you written notice.

DM in our state it is one whole rental period of notice, the courts up here will not accept a notice as proper if notice is not sent atleast one rental period and one day ahead of the notices effect date.
That means notice must be given now so it would be for the end of June.

The only exception MIGHT be if you paid rent weekly OR the house was foreclosed on...otherwise 30 days seems to be what is required.

The notice period to terminate tenancy is one rental period written notice in the State of Minnesota (MN).
This may be the case regardless of month-to-month or annual lease agreement with term. (The written laws for MN are not clear.)
