Mother Moving to different State

What is the name of your state? Pennsylvania My grandson is ten years old and my son pays child support. They were never married. Now his mother has decided to move to Florida and she is moving at the end of February. Can she take him out of state without my son's permission? And if she is allowed will his child support go down since she said my grandson can visit his Dad for six weeks in the summer? Would like some help here if anyone knows. Thanks.

What do your son's divorce and custody papers say about moving out of state? We cannot answer anything without facts. It may change the visitation schedule and she may be responsible for transportaton costs. Usually there is a required notice prior to moving and possivly a hearing. Has anyone filed any court papers?

My son was never married to the girl. And I am not sure what the custody papers say. Will it say in his papers about relocation? I will have him check them. He just found out about the move so there isn't any court papers filed yet. It seems she isn't planning on giving anyone notice as far as I know.

Can she just take my grandson and leave the state without the fathers permission? She isn't giving anyone much notice. If my son contests the move will it get into court before she leaves? What if she leaves without him contesting? Will he be able to do anything later on? Will he need a lawyer if he contests the move?

Check with an attorney in your state but I know here you have to send a certified letter 60 days prior to the move notifying the other parent of the move and also state in that same letter as to why the move is in the best intrest of the child. Just check your state with the regulations of a Relocating Parent Law. Married or not apparently he has visitations so he has a right to be notified especially since moving so far away.

Do also remember that it is up to your son to contest this move...not you...you don't have any "rights" where this issue is concerned. Its between dad and mom.

Yes I figured that. Son doesn't have a computer so I was trying to see what we could find out on here. Thanks
