Hi,
I am an American Citizen originally from over seas , my mother got her green card recently based on my American Citizenship . Can she apply to get (sponsor) My unmarried ,24 years old brother based on her green card ?? or she needs to wait till she will get her Citzenship in order to be able to request getting him from over seas to usa?
Thank you

As long as your brother is not married and stays unmarried, your mother can petition for him as a permanent resident but the wait is going to be a very long one: 5-6 years given the current processing times. As soon as your brother marries, he will no longer be eligible for an immigrant visa as long as your mother is still a permanent resident. However, once she becomes a US citizen, she can sponsor him regardless of his marital status.

Re

Thank you Lana for your prompt response. I have 2 extra questions please :

what if the permenant resisdent mother who submitted a request to sponsor her unmarried son passed away before he got his immigrant visa approval ..then is he going to lose his immigrant visa or he can still get it ?
Thank you

The petition becomes invalid if the petitioner passes away and the beneficiary can no longer obtain an immigrant visa on the basis of that petition.
