mothers day/summer/travel expenses

What is the name of your state (only U.S. law)? CA

Does California have any law for Mothers Day and Fathers Day about how the Mother gets that day and vice versa? Our CO does not touch base on any holidays at all. (It's temp. until June when we have another hearing.) My ex has our daughter on Mothers day, and he is not willing to let me see our daughter until 6pm on Mothers Day, when his visit ends. Now I know that his visit is HIS visit, but it makes me a little sad that she will miss out on mothers day with our family.

I have a child support issue also...I hope it's okay for me to post here, instead of starting a new thread. I had emailed him about our daughter starting an extra curricular activity. I asked if he would be willing to pay half of the monthly tuition. OUr current child support states that he is to pay $384 a month, but I have never received a full payment. His response to my email was "I paid $200 last month in child support and more than the $184 remainder in travel expenses which the judge is not taking into consideration at this time." Then he actually goes on to say that he does not want our daughter doing any extra curricular activities until after summer b/c she will be with him the majority of the summer. As of now he has only been granted one week of summer.

Which brings me to my next question--What is the typical summer vacation visitation schedules? When summer comes, she will only have seen him 8 weekends.

He moved 6 hours away, b/c his GF moved to go to school. It's not like he moved for a better job or something like that. Then after pursuing visitation, he asked the judge to order me to reimburse him of his travel expenses OR have it deducted from his arrears. The judge denied that. :rolleyes:
He was able to get CS lowered almost 50% due to changes in both our incomes.
He thinks he can just not pay the full amount b/c of travel expenses. Does the DCSS take travel expenses into consideration?

Take him back for contempt on the child support issue. Also, for summer, he may get half the summer. Truthfully I can understand not signing up junior for anything until after the court hearing in June.

How sad do you think the kid is when they have to shuffle from home to home? Sadness is a part of life, especially when adults decide to divorce.

Actually, if it's in regards to visitation, the family code allows it.

But the judge has to actually order that. A parent cannot arbitrarily reduce their child support payments due to travel expenses. I think she was asking if dad could arbitrarily do that, not whether or not a judge could take that into consideration when setting child support.

This is what I was asking. He already tried asking for it, but it was denied. So now he is just doing it on his own. From reading these posts on this site, it seems the majority of the time the judge has the parent who moved pay for the traveling. And he was the moving parent.

As far as Mothers Day, oh well. I will get over it. :)
CC you are right (your signature comes into play) it IS sad for our daughter...it is LIFE. & thank God I didn't have to go through a divorce, we were never married.
