What is the name of your state? New Jersey

I bought a motorcycle on eBay for $5,400 cash. I am the owner 3rd owner. When I paid for the bike, the owner at that time said that he was going to use the money to pay off his loan and mail me the title within 2-3 weeks. Well, he paid off his loan and handed me a title only to find out that the origional owner never paid off his loan. The 2nd owner never registered the bike and neither can I. One other important thing, a contract was never made/signed. The 2nd owner refuses to refund the money. Can I get my money back? If so, which owner would I sue?What is the name of your state?

The second owner can't sell it without a clear title and I'm not sure how he could possibly have ever obtained such a title to give to you, or ever gotten plates for the motorcycle to use himself, if the first owner had never paid off the initial loan! You may try to threaten that if he doesn't refund your monies that you will file a complaint against him with the State Attorney General's office for illegal sale of a vehicle without a clear title, or find out what's going on through your state licensing bureau. Is there not a lien on this title? In my opinion you'd easily win this in small claims court, but unfortunately you may have to go that route to recover your losses, or some of your losses! , Your state may have a low small claims court maximum that could be well below your $5,400.00 investment. :eek:
