History: Divorced in 2003. Five children involved -- 3 are not legally xhusbands but he has raised them and 2 are. While he obviously only has to pay child support on the two that are legally his and maintain insurance on those two, he is active in all 5 of their lives which includes visitation etc.
I remarried in 2003 and moved 25 minutes from where we lived as a family. I have no family here as we are from Texas originally, moved here for his job (I had been a stay at home mom) to a town of 24,000 people. After divorce I went to work. Due to jobs, I moved in 2005 to the town that I worked in which was about the same distance from xhusband as where I had lived. Six months later, my current dh got a new job and required us to move right across the river into SD and was approximately 50 miles from xdh. Spoke with him and he okayed the move. In 2007 I left my company (I had worked my way up to President and CMO, but due to ownership change decided to have them buy out my contract) and begain searching for a new job. The town I live in has 13,000 people and was not able to find a job. Also looked in the town where I originally lived and xdh lives -- also could not find a job. Mind you, there is not an abundance of jobs. I have to maintain insurance for my 3 oldest children -- one of which has medical problems and cannot have a lapse of coverage. I took a new job in August of 2007 which is 100 miles away from where i currently live and 150 miles away from DH. I currently drive back and forth.
I work in management, have a good career and am able to provide a stable lifestyle for my children. I now want to move to the city where my new job is. Current DH has decided that he doesn't want to be married (not sure what he wants -- he was also in an executive position and up and quit his job in november and still doens't have one) and I am the main provider for my 5 kids. Problem is xdh says he will not let me move. Visitation would not be interrupted as I would transport the children to visit him atleast 3/4 of the way to our current meeting spot. XDH wants to make sure that I always follow the agreement to a "T" but he asks for allowances frequently -- change in weekends, later pick up/drop off time, etc..... he recently informed me that he was going to Trinidad for 5 months and wanted the kids to come to Trinidad to visit him for several weeks. Other than a few visits he would be missing the majority of his visits for 5 months.
I have spoken with my attorney and it looks like this will go to court since he doesn't want to go through mediation. He is also threatening to seek custody of the children. Is any of this possible? He tells me I can get a job at Wal-mart -- I am sure I could, but I realistically could not support my children on that kind of wage. I have always tried to work with him -- this is not an attempt to come between him and the children, just an attempt to provide for my family. There are many things I could fault him on and bring up here, but that is not the purpose -- I just want to get some insight as to if he has any validity. My attorney does not seem to think so.
