I filed a small claim in june of 2000 against a nail salon. Since then, I have been in court at least 5 times due to the defense attorney. I have been very cooperative. Somehow it ended up in arbitration. I never agreed to arbitration. But due to serious illness, I was unable to make the arbitration date. I filed for a new date. The Defense attorney has filed a motion to dismiss. I missed due to extenuating circumstances. Will the judge listen to my reason or just throw it out?
