What is the name of your state? New Jersey

I have owned my house and property for 17 years; when I purchased it the back yard had a 4 foot high fence which was 2 feet inside my property line as defined by the survey. The same fence is still standing and has begun to fall apart. I'm going to replace it, but want to move it to the property line as defined in the survey in order to reclaim the 2 feet of property on the other side. I'm selling my house and the 2 feet will make my yard look bigger, since it is relatively small. The other side is the back of my neighbor's yard.
My 2 questions are:

Do I need to clear this with the neighbor or can I just go ahead and put in the new fence on my property line.

Since I'm replacing an existing fence (albeit 2 feet further back) do I need to get a permit?

Any help is greatly appreciated as I'm on a very tight schedule in terms of having the house ready to show.

As we discussed in other threads, it's always good to get a survey to prove to your neighbor and yourself where the exact property line is --- right now there's no dispute.

As far as the permit, these are very local things and you will need to check with your building dept to see.
