What is the name of your state? NH I want to take my children to florida, does anyone know the laws of taking your children out of state? I know my x husband will fight to try to make my daughter stay here.

Umm, I thought the kids wanted to live with Dad? In any event, he can certainly contest to his children moving. If he contests, don't count on a judge allowing it.

Why are you asking this forum anyway's?

You have to notify the court and your ex of your intent to move within a certain amount of days before the move. He will then have the chance to contest the move in court. You will have to prove that the move will be in the children's best interest and not yours.

Can you do that?

And he has every right to.

Maybe you should give custody to dad, therefore nothing will prevent you from getting your trailer off the cement blocks and moving whereever it is YOU want to relocate to.

The father may have every right to protest the move but that does NOT mean the Judge will not let you move. I had a similar case where my current husbands job was relocated to California. We were living in Virginia at the time.

True. But it doesn't mean the judge WILL let her move, either. Considering that Dad is apparently involved AND that the kids want to live with HIM, it's not impossible that she'll be told to stay put or give up custody. Plus, she never said why she wants to up and move the kids to FL.

The judge can't stop HER from moving at any time but he can tell her that the kids have to stay.

You are right. We don't know why she wants to move. I was just stating that the judge won't always say no. My x is involved with our children as well. 1 big difference is our girls want to live with me. :D

Of course daddy has to approve. Btw, do the KIDS want to move far away from dad or do they not know anything about your plans?

Why should you be able to take the kids away from their father? If I were him I would fight too.
