Hi I live in Texas, my husband is in the army and we are going to get a divorce, neither one of us has filed yet. We have a history of verbal/mental/physical abuse and my mother in Alabama has offered to have our three year old daughter live with her until I am able to move out of our on post housing, and get back on my own two feet. This should take about 2 months. My question is that since my husband and I are not on speaking terms right now, and are seperated, i have the child, would I be able to take her to alabama to live with my mom, or can he say that I am abandoning her? What can he do legally if i send her since he is showing no interest in his child. What can I do to make sure this won't turn out to be a bad mark against me when we go to court? What options do I have?

are you going to remain in texas or are you going back to AL? would your soon to be ex be able to take care of her while you are establishing a home?

can you not establish a home in less time? i don't know if i would actually say that you can't provide for her and you want your mom to. but you could have your daughter go to visit grandma and aunts and uncles, cousins, etc.
