Moving out of state with child

What is the name of your state (only U.S. law)? MD

Hello,

I have sole physical custody of my child who is 9 years old and have had for over 5 years. His mother is suppose to live within 20 miles per agreement, however she has moved about 60 miles away. She only sees him every other weekend and is very inconsistent. She does not pay child support (which I've waived) and really doesn't do much of anything to be honest. In any case, she is in violation of our agreement.

That being said, it's not exactly the issue. I would like to move to another state, South Carolina where I have some family and my wife has family. It's more affordable where we would like to move and we both have job opportunities, in either case.

Does anyone have any experience in MD moving a child out of state and have any recommendations to help me move forward if his mother won't come to a sensible agreement? I'm fully open for summer vacation, every other month, other holidays, etc. And of course there's daily phone calls, skype, etc. (which doesn't happen now anyways).

Mom is the child's family. Why is it in the child's best interest to move her so far away from family?

You current wife is a non-issue. She has no play in the game.

And as stealth said, is this a court order?

Right, so in this case, the burden is just on me to build a case for why it's also in the childs best interest? I know some states it's on the non-custodial parent.

One thing you need to be aware of is that visitation is a Right, not a Requirement. Mom is exercising rather standard visitation.

I would suggest that you research MD statutes for relocation. Google is your friend.

And.... Your CHILD'S family is in MD.

Not also but the ONLY interest. Your best interest does not matter in this case.

Why is it in the child's best interest for you to move her so far from her family?
