What is the name of your state? Colorado

I am trying to figure out my legal rights to move my kids and myself back to Kansas - my husband and I are separated and have not filed for divorce - it is to the point where the next step is filing - the kids live with me and I am the primary caretaker - my husband has been out of the house for over a year now -

You ask the court, ask your H. See if you are allowed.

As a father, I can understand him fighting. You are acting like the time the kids would be without their father is no big deal when you posted "the only thing I am taking away is time with their father".

You should be trying to have your children and their father have a relationship, not taking time away.

When moving out of state (or long-distance within state), how is it in the "best interest" of the child? And don't rationalize it with "all MY family is (fill in the blank)" because the children's family is mom and dad. For what reason do you want to go to Kansas?

You can't "prove" any such thing. :rolleyes:

You will not get primary custody with that attitude. The most important thing to a child is their relationship with BOTH parents! Not uncles, aunts, Grammy and Granpa...MOM AND DAD! The parent that is most likely to facilitate a relationship with the NCP will get PC.
