i have posted on this board before concerning my problems with my landlord. we have bought a house and are moving out(thank god)my question.... my husband has given our 30 days notice and told the landlord to use our security as the rent for may. they have agreed i also put this in writting to them just to cover myself. is it true that the security deposit was supposed to be put in escrow to collect interest?? and being that they have accepted using the security as rent for may that they cant come to us at the end of the month and claim anything that we damaged? not that we did damage anything, but i dont trust them.

YES they can..... so take LOTS of pictures of the apartment before you hand them back the keys, and it is a very good idea to get them to sign the agreement to use the security for last months rent...

Yes they are supposed to put the securiy in a seperate interest bearing account, but you can use that against them if they sue for for any damages.
