Moving to new state to quicker divorce..?

Hello all I live in Virginia right now and was married in 1999 in August..I was 18 at the time and my wife was 17..We have 1 child together which is 2 1/2..He was born before we got married. We have been seperated since October of 2000 and we both want a divorce, everything has been settled verbally and just want it official..I do not want to wait for the 1 year law that Va has..I did live in Las Vegas for a few months last year and remmeber that the law there is 6 weeks..MY question is Would i beable to move back to las vegas and file for Divorce and have it all go well? Im willing to relocate back there and stay there. Any help would be great. Thanks

I can answer this in terms of Indiana law only....

Each state has residency requirements. You may have to live in Nevada for six months or a year before you could file for divorce there.

Furthermore, if negotiations break down, your spouse (who I assume does NOT live in Nevada) could decide that she doesn't want to be subject to the power of a Nevada court and could have the divorce tossed out of that court for lack of jurisdiction over her.

You didn't say whether anything had been filed in Virginia already. If it has, you would likely have to get that case dismissed first. The second court probably isn't going to mess w/a case that has already been filed elsewhere and is still active.

(In Indiana, it's a 60-day waiting period. Yours seems rather long. Are you sure that's right?)If that IS correct, why do you have a problem waiting for a full year for a divorce to be final there? That's really not that long, and you may not benefit by trying these other ideas about moving to Nevada.

Besides, moving will make it much more difficult for you to have a meaningful relationship with your child. I'd stay nearby if I were you....
