What is the name of your state? CA.
I live in California. I recently got a speeding ticket in colorado state (50 mile zone speeding at 69mph). The ticket says its a 4 point violation in CO and will be reduced to 2 points if I pay the fine with in the court date. I called the court requesting traffic school, they have asked me to appear in the court to request traffic school. Is it worth the pain to go there to request the traffic school or just take 2 points? The reason is in CA 2 points violation is considered to be a big violation badly affecting the driving record and insurance. When I called DMV, they say the 2 points in CO will not be converted to the equivalent points
in CA.
thanks in advance

This is true as far as it goes. In your case, it does not matter how many points CO assesses. What matters is exactly how the violation is reported back to your home state. Many drivers have been told that if they just pay the fine there will be no points. That may be true in that particular jurisdiction but in your home state it could mean a four point ticket.

It may well be worth the trouble to retain an attorney to try and get traffic school approved. Many courts will accept an out of state or online certificate.

lwpat: thanks for your reply.

Can someone refer a traffic law attorney in South Fork or Alamosa in CO?
thanks

Go to traffic court a week before your court date & look for a person in a suit. That's probably an attorney trolling for clients.

The problem is I live in CA and I can't go there just to find a traffic law attorney. Thats why I was requesting if anyone knows an attorney in that area.

What is "deferred sentence"
When I called the assistant to the judge for my options, she suggested an option "deferred sentence". Any comments on whether I should take it or not? I have hard time finding an attorney in that area since its a small town.
thanks

A 'differed sentence' is the same as 'deferred adjudication'. Simply, you agree to plead guilty and perform a specific task (usually defensive driving, no violations for a period of time, etc.) and they will remove the violation.

Call the clerk back and ask them for the specifics, any forms and what cost.

I called back the clerk, she said I still need to pay the ticket if I'm eligible for the deferred sentence which I'll get to know later.
I was told that I must sign an agreement with the court that I'll be on probation for a certain period of time (may be 6 months)
and if I don't receive any more violations no points to my drvg record. There seems to be no other forms involved.

Sounds like a plan. One thing you may need to check is whether your home state or insurance would still recognize the points or if they will also be waived.
The question becomes, how will the Colorado court finalize the issue if you meet all the requirements. Simply, is the ticket dismissed, shows as conviction, etc.??

jetx: thanks for your input, I'll try to find all these information, however I'm not sure if the clerk knows all these details.
thanks again.

Ignore that last post (by Des77). It is simply a SCAM trying to sell you a MLM pre-paid legal service. HUGE problems with them as they are a well-known scam.
Also, his/her posts are about to be booted.
