What is the name of your state? California

I just recently started a thread about me planning on moving to VA in August and how my 21 month old daughter's dad now wants to be on the birth certificate.

Well things have changed and I am actually moving at the end of March. I haven't heard anything from my daughters father. I just want to know if I can move with out having to go to court or anything first. He is not the legal father and not on the birth certificate. If I move will he be able to do anything about it?

You are free to move, however he can rush to court and file for paternity/custody/parenting time and establish juridiction in CA, which means that at a minimum (if he does that) you will have to return to CA for court, and could even be ordered to return the child to CA pending the outcome of the case.

If he does that after I move, they can still summons me back??? I dont think that is quite fair! If he has waited 2 years to establish paternity and hasn't seen his daughter in quite some time, why would they make me come back?

Because the state where Dad lives will still hold jurisdiction until you've established residency in your new state. Too bad, so sad - take care of business before moving.

Does anyone know the laws about how they determine the visitation with a toddler, since she cannot fly on her own. Will they have one the the parent fly to get her and fly back with her? Thanks for your help.

It normally takes 6 months to a year to establish residency. The parent that created the distance is usually the one responsible for transportation for visitation.

You are free to move, actuallly. He is not the 'legal' father bc there is no Paternity established, you were never married, and you are at the 2 yr rule mark. CA is unique in this specific type of case. Dad could file to establish paternity and try to convince CA courts to take jurisdiction of a child out of state he's waited 2 yrs to act upon....but I hope he's got some cash.
