I was wondering how did napster get shut down and all the MP3 sites out there are still running for doing the same thing that napster did. Are they paying royalties to the music companies or are they doing something different than napster and therefore have found a loophole. I also found a site that you can download movies wouldnt that be a copywright infringement too? I was thinking of starting MP3 and movie site but I dont want to get sued like napster did. Any advice would be helpful.

and all the MP3 sites out there are still running for doing the same thing that napster did. Those operating on the napster file sharing principle are either being sued or running scared. Kazaa, etc.

Are they paying royalties to the music companies or are they doing something different than napster and therefore have found a loophole. They are operating under licenses and, presumably, paying their licensing fees. See, e.g. MP3.com's agreements with BMI, ASCAP and Harry Fox. Those that are not operating under licenses are running scared or are in litigation.

I also found a site that you can download movies wouldnt that be a copywright infringement too? Not enough info. Would need to see the site and what they say about licensing. You absolutely would need licenses. Films (and television/video) are copyrighted/copyrightable works.

I was thinking of starting MP3 and movie site but I dont want to get sued like napster did. Any advice would be helpful.
