Oklahoma. Going through seller's agent, made offer on house, bank sent back counter offer, we submitted second offer, bank submitted counter offer verbally, to which verbally we accepted. Agent said his office informed him that there was another offer sitting on his desk and that he had to submit that to the bank before we could accept their counter offer. Now he says their offer was more than the amount the bank countered to us, so the bank has the right to accept that offer. The bank, in its contract, stated the property is being sold as-is, no repairs. The other offer includes provisions of repairs and such. If we accepted the offer, can they just make us wait until they decide on another offer?

That agent is full of crap.
But because the agent represents the Seller and not you, this kind of unethical BS is to be expected.
Get your own agent.
Right now you have no offer and have no contractual relationship with the Seller.

After we called the realtor this morning and told him we had a call in to our attorney to see if this was legal, he called back a few hours later to say that the bank has accepted our offer and we can come sign the contract.

Thanks so much for your response.
