municipal responsabilities to service drive owners

My question is simple. The city I live in has a series of service drives which houses the cities utilities and services underneath. The property is ours we pay taxes on it and in addition to housing the utilities the city makes garbage and recycling pickups along our drive. The problem is that the drive is in need of serious repair (complete replacement of the blacktop) . I have been round and round with the alderman i have now contacted the city administrator who says that maintenance is our responsibility. the damage done to this drive is not from our vehicles but from their garbage trucks. Does anyone know of a law covering this or precident setting lawsuit. any info would be appreciated thank you in advance.

If this is the same as a private alley there may not be anything you can do about it other than as a group for every one to plan on it being repaired /rebuilt to exceed what ever standard was used to when it was paved the last time OR as a group refuse to do more than add gravel where needed and leave it stay as it is. BTW was this a city alley way that was vacated ? If it was vacated how many of the structures have own driveways , in other words by mutual agreement with every property owner could this alley way be eliminated and every one each get full and exclusive use of its property? I suggest your going to have to speak with a real estate ATTY regarding the damages and TALK to your nieghbors about getting rid of it.
