What is the name of your state? PA
I am the primary residential parent. Our original child support order was done via the state guidlines three years back. My child's father (exhusband) would like to go back to school full time and now we'd like to file our own child support agreement. I have some questions:
1) Will PA let us come to our own agreement and have it filed like a normal order? Directly withheld from paychecks for example?
2) We're going to agree to a lower amount, but I would like to have it stipulated that the lower amount takes effect so long as he is in a full time post secondary program, and we revert to guidline if he drops out/skips a term/fails out etc. Is this even do-able? Any ideas on how that could be worded or worked?
3) He has a stable position right now but will be voluntarily working fewer hours while in school. If we go by the lower agreed-upon amount while he's in school and then he drops out after a year will they calculate the guidline based on his lower hours (last time they went with the previous 6 months paystubs) or will they go by his demonstrated earning potential at that job? Could we write in something that would address this?
Any other suggestions? He's usually bad with follow through, so I'm hoping this will not only give him the ability to GO to school and still have time for his eow visits (and set a good example for our son), but will also encourage him to actually finish this time.
