I live in Wisconsin. Before my husband and I were married, my husband suffered from severe mental illness and was placed on social security and disability benefits. Before he was placed on these benefits we had a daughter when we were not married, but who was legally his child. Seven years later we did get married and had another child. Sometime after our daughter was born and we were married, he was placed on Social Security/Disability benefits. I had wondered whether my children should have received social security benefits or some sort of benefits because of my husband receiving full benefits.
When I was younger I knew a girl whose father was on disability and the children each also were sent checks every month until they reached the age of eighteen, or twenty-one if they stayed in school. When I checked into this matter with the social security office I was simply told it wasn't set up that way. I didn't understand it then and recently my husband's mother tried checking into the matter again after ten years and was still told that my husband's social security, disability benefits weren't set up so that the children could receive any benefits. I don't understand this. I have never encountered anyone on disability whose children were not also entitled to benefits. My children are now twenty four and sixteen, and I fear that they have missed out on many years of payments they should have been entitled too. Can anyone help with advice in this area? My husband and I are still legally married although we have not lived together for over thirteen years and I have been the sole supporter of my children. Are they entitled to benefits? If so, could they get some retroactive for all the years they did not receive any benefits? I believe my husband may be receiving benefits under the SSI program and not through any work related social security and disability. Thank you. Please feel free to email me at: [email protected]

It is my understanding that SSI is the same as a welfare benefit for the disabled and is not a program that pays for the children an/or spouse. Were as SSA is based on disabled with work credits to be eligible or retired. Check out the SS internet site and it helps you understand and has a question section.
