I am in Maryland, my dad is in California. The car was in California with my dad.
I bought my parents a car 12/2005 on my credit with the agreement that they would pay the payment and the insurance every month until payed off or a time when they could put the loan in their name. My mom had been making the payments with her SSI check but in02/07 my mom passed away. My dad was only working day labor so he could not afford the whole amount. My younger sister (still living in that household) agreed to pay the car payment and I agreed to cover the insurnace until he could find a regular job (within reason) This continued through for about 5 months until about July when I started to get more aggressive with my dad about finding a job because I could no longer afford to pay the insurance. Although he had been very agreeable up until this point, after I told him I could not pay he got mad and tryed to lay guilt trips on me saying he would kill himself. This made me very angry since I had just lost my mother in Feb. After this point my sister was having to come up with the car payment + insurance. She did this for 7/07, 8/07, & 09/07. Until she no longer able to make the full payment. We just now picked up the car (10/14/07) and sold it to a cash for cars place. The car loan was 11055 and we were able to get 5800 for it leaving a balance of 5258 (A big reason I was only able to get half of what I owed was the damage he had done to the car) I got a loan for that amount and asked him to make the loan payments & he has refused. If I sue what are my chances of winning?
My dad is now working a regular type job so if I did sue and win he would be able to pay me. Would I have to file in California?What is the name of your state?
