My dogs and the Vet.

Backround:
I am in Australia now and have been since April,2000. I left my dogs with a local Vet in Redding, California to take care of them while I was gone.
I left them with a deposit they required at the time and I left for Australia. I called the Vet's office after a month and told them I would be away longer and I was told my dogs would be fine until I returned.
The following month I start receiving messages from my brother that the Vet is going to say my dogs are abandoned. I called the Vet and asked what is the problem and he says he has not heard anything for a while so he says thats a good way to get a fast answer. He also asks for more of a deposit. My brother them gives him more money. In the meantime the Vet has still hassled me about more money on a regular basis and claiming he is going to declare my dogs abondoned.
Several faxes have been sent to him to assure him that my dogs are not abandoned. The Vet has had full contact information here in Australia.
As of 2/8/2001 my brother signed for a registered letter sent to me at my brothers address. This letter comes after another fax was sent to the vet and is a notice of a small claims court hearing this month. The amount he is claiming is by no means the total he is due to date. My brother has left the vet serveral phone messages which he has not received any replies. My brother even offered to pick up my dogs from the vet, but the vet refused. This Vet is being a total jerk.
I can not make the court date and I have not received the noticed as yet. My brother is to fax me a copy today.
I need advise on how does one notify the court that I am not able to make the court date and how do I get someone to represent me. Any other advise would be appreciated as well.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

This is what you do: if you want quick removal, give your brother permission via a written fax to take the dogs. Then have your brother take all the faxes to the sheriff's department and have them help him remove the dogs. If that doesn't work, have him hire a general practice attorney to sue the doctor for conversion of your property.

My Dogs

A vet has declared my dogs abandoned and has not replied to any of the faxes sent to him stating this is not the case.
My dogs were left in his care while I am away and refuses to tell me where my dogs are.
I am not happy and I need to know what I can do. I left them in Redding California and I am in Australia.
