I live in West Virginia. My ex lives in Kentucky. He is getting out of the army and moving to Ca. We have joint cudtody of our 2 children 3 years and 9 months. He has never had our son all night and didn't even buy him christmas presents. He is coming to visit the children for 1 week up here. Then he won't be seeing them for 8 months. I need to know if there is any provisions for his visitation. How can I send my children to CA to visit a man that they won't know. He wants for the just to get on the plane with him when it is good for him and he doesn't want to get to know them here first. We are both originally from WV and his family does live here. Can I make him come back here to visit for a while before they go to see him by themselves. Am I able to object to him moving all of the way out there since he is the non custodial parent? Or should I just try to go to court and modify our custody? Our divorce took place in KY. Also when he comes up to visit he will be unemployed and staying in a hotel with his girlfriend that my children have not met. Do I have to let them spend the night with him?

You should petition the court for a modification of the existing custody orders. You can also request that the children not have to fly or travel to CA until they are older. I myself, if he has had not established a parent/child relationship with them, would request that he have supervised visits until he has established a parent/child relationship. Some courts will require it, some wont. Your best bet would be to talk to a couple of atty's in your area, and get a feel for how the judge in your district usually rules in cases such as this.
