My fault accident

What is the name of your state? Indiana

I swerved to miss a deer and put my car in a ditch, the insurance company is calling it a total loss. The blue book on the car is $6900, the car sells for $6900 to $8900 at a dealership. The insurance company has offered me $5033 after the deductible. Is there anything I can do, or am I stuck with what they offer me. What about personal loss, do I have a recourse since it was obviously my fault? Thanks.

What is personal loss? Recourse for what?

The dealership selling price is irrelavent. Ask your adjuster how they came up with that figure.

What is your deductible?

All you are entitled to is FMV (fair market value) for your vehicle. Go to auto-trader.com and find vehicles in your area, (same make, same model, same condition, close mileage) and that's is what should be offered to you.

Just as an FYI, if you had hit the deer, it would have been considered a comp claim, but since you "hit" the ditch, its considered an at fault accident.

What's your deductible amount? $500? $1000? Either way, its a good deal what they are offering you. And as for your "personal" loss, were you injured? There is some coverage on your policy for injuries, missed work, etc...
Contact your agent/provider.

Not a good deal if his vehicle was in "excellent condition" with "low miles" and they are only offering him... "offered me $5033".
