I live in MA. Had auto accident May 1999 deemed to be 'my fault'. Chose to plea my cause before the insurance board...yep, it took this long until my case came up. I go next Wed., 9/27. I need advise on how best to plead my case...and WIN! Have never been 'at fault' for an accident in 22 yrs! Insurance hike is killing me! There are no witnesses recorded on either side for this incident. Very busy morning traffic, I pulled from side street onto main road (turning left) a car was coming towards me turning down into the street I was pulling out of. Well, another car, unseen by me, was RIGHT behind this one, and passed it on the left (presumably crossing the double yellow lines)and ran right into me! she didn't even appear to TRY to stop! I came to a complete stop once I saw her, (I was out to the yellow lines). This street is heavily congested in the a.m., parents driving kids to high school, people know this area and are frustrated by it, apparently this young girl had a bit of road rage. I have tried to capture photographs of cars at that area of street at the same time of day (with traffic congestion)doing what caused my accident, passing on left, teetering onto double yellow line. Should I do anything else? Any points I should bring up at this hearing? ANY advice from anyone would be helpful and appreciated greatly!

You seem to be thinking in the right direction....

That this intersection was an accident waiting to happen, and it DID!

Pictures especially if they are COLOR would be very usefull.....also on the police report did it state the other car crossed over the Yellow line, were there any pictures taken at the accident scene...you are entitled to those.

Also can you find out from police records, or how many other accidents were at this intersection in the last couple of years.....they DO keep records like that, traffic might have them , that could help .

Have they put up any NEW traffic lights, signals, new signs new road markings, after your accident.....that would show they knew it was dangerous.
