and im so nervous...Im so scared! I feel that if my ex's lawyer files for a case study then I would have failed. Does anyone know how common it is for a judge to order it? and if my lawyer objects to as not neccesary will the judge agree?

I dont mean i would fail the case study, what I mean is that im going to feel really sad and bad that the hearing was not done. I f he orders a case study its going to postpone the case for god only knows how long.

Ok. NONE of us can predict what a judge will order.

What is the case? Were you married? Is he the legal father? What is he asking for? What are YOU asking for? How old is the child? What allegations were made? Do you both have representation?

He is the legal father. We were married, then when we seperated I became emotionally unstable. My babies were 10 months adn 1 and a half and I was very young. The father was stable at the time so I asked him if he could take them to live with him at his residence so that I could stabalize myself. He took them, in our divorce decree it stated that their primary residence was with him. I went thru LEGAL AID for the divorce and did not understand the legal aspects of the case. I then learned that I couldnt just "get them back" that I would have to hire an attorney to do so. It was so costly. Its been exactly 2 years and I finally saved up the money to do so and I have a strong cae. I have always been in their lives, never not once gone away. I think I prob spend more time with them then he does anyways. The boys are 3 and 4. He does have a lawyer also, im assuming. Both of us are really good parents.

What change in circumstances for THE KIDS are you alleging that would make it in THE KIDS best interests to change custody?
