My HOA doesn't do anything

This is in California, Sacramento County.

I have had a Homeowner's Association since I bought the house new. It is run by the builder and always has been. I get charged something like $50 a month for this HOA, and they don't do anything. Cars are left parked in the street and always have been, although that is supposed to be against the rules. People leave their trash cans out, boats in the street, whatever. At one time they enforced the rules minimally, but I haven't seen any evidence of them enforcing anything in the last five years.

So they are in breach of contract, it seems to me. Can I stop paying the dues?

It could be, that after a certain number of houses are sold, the builder must cede control of the HOA to homeowners. Is there a document to that effect?

Usually, HOA's have rules. When you do not feel they are following them, you look into the rules to see what is needed to replace those controlling its actions. You should have looked into this before buying your property.
