I purchased a house 2 years ago, I allowed my girlfriend and our son to move into my house with me. She accused me of domestic assault which resulted in my being removed from my house and being arrested. She has custody of our son. She does not work and has not contributed to the upkeep/expenses of the house. Her only income is child support for her 16-year old son, who also lives with me. How do I get her out of my house? What legal recourse do I have?

My response:

While you have failed to tell us your State, it is fairly common in all States that you need to serve her with a 30 day Notice of Eviction. When she fails to leave after proper Notice, then you'll have to sue her for "Unlawful Detainer." That should take another 30 to 45 days after filing.

Well if the house is in your name only then SELL it..with no lease she has no choice but to leave, and you would have NO responsiblity for any damages if shes homeless...
