I was involved in an auto accident a year ago. I was driving, my 16 month old son was in back middle of car in car seat. My car was hit by the front of her car straight into my front passanger door. I was going about 43mph, she was going well over that, and had been drinking. There were many witnesses. I was taken to ER by ambulance. Xrays of neck were taken, but since I was one month pregnant, that's all they checked, even though I was having pain in my shoulder. My son was in server pain, unable to lay down to sleep or nap without screaming histerically for two hours each time for about two months because of dislocated hip and pinched nerves in neck. I had whiplash and back pain. Now he seems fine, my only problem is shoulder and arm pain, had MRI last week (had to wait until after birth of my new baby) and diagnosis is bursitis. I still have alot of pain in shoulder, dr said to continue exercises and streches and take tylenol and use ice. It will take time to get better. I'm breastfeeding so pain shots are not an option. I am still off work, do typing for a living. Girl who hit me was uninsured, but I had uninsured coverage with my ins co. The claims adjuster offered me $500 cash (to cover my deductable to fix my car) and to pay for my car to be fixed. He said then I needed to turn over my medical claims to my own health insurance and not to tell them my car insurce would have paid and we'd be settled. I refused, called my insurace co and they said I was correct, it would be wrong to lie and have them pay medical bills. Adjuster had me in tears implying I was lying about pain and problems. I also had to miss the last week of my full time job, and quit my part time job I was starting in two weeks. He refused to pay for job I didn't start, insisting I can get another. However it was a parttime job where I could take my kids with me. I have not been released yet, but have been looking for another job like this, and none where my kids can go with is available. I have to settle claim within two years of accident, which is 1 year from now. I have metioned to insurance I am ready to settle, but am getting no where, except being accused of lying about my pain or that it was not from the accident. (I have dr's proof of injury and that is was not preexisting) I am so stressed because of money being tight with my income gone. They owe me over $5000 already. They said they can't compensate me for work missed until I sign for complete settlement. How do I get them to hurry up with offer, and about what is a resonable offer? I want to know if what they offer is fair, when they do offer. Is there anything I can do to get backpay for job now, since the money is needed?
