What is the name of your state (only U.S. law)? WA
On Christmas day, my ex husband (son's father) was here as he spends every Christmas with us. He got feeling quite ill and we called for medical assistance. While he was in the ambulance, my son (34) and daughter (27) got into an extremely loud argument. The EMTs called the police. Both kids ended up getting arrested for Domestic Violence #4. My son was taken into custody, but was never read his rights. Due to a bad asthma attack, my daughter was read her rights but was not taken into custody. My son had been wrestling with our dogs earlier in the day and had a scratch on his neck. The police said this had happened while they were arguing, which evidently was the basis for the arrest. No one gave the police any statements, although we were all pressured to give them. My son's computer is down due to viruses, my daughter's is not working, although she is trying to borrow one to post on here herself. They have both asked me to post for them. Their questions are, what exactly is #4? What are the consequences of this? Should they have lawyers before they go into court? I am more than embarrassed to have to admit this has happened, but they really do need advice on how to proceed from here. All advice and information regarding this would be most appreciated.
