What is the name of your state?CA

Due to a bad divorce i am over my head in over due bills and debts. Right now i am not working and only have child support as income. What should i do? I feel like BK is my only choice.
 


1. How much do you owe?
2. Is any of the debt from student loans or taxes?
3. Do you own any assets (car or home)?
4. Are there any judgments against you or have you been credibly threatened with one?
5. How old are the debts? When did you last pay the original creditor?

i owe over 20,000 in bills and 14,000 in student loans. i do have a car loan but my ex was supposed to pay it now they are comming after me for the money. they will not take the car only want money. no judgements that i know of. my debts are about 4-5 years old and i havent payed anyone in a few years.

The SOL in Ca. is 4 years. If you're within a year of that, I'd hold off filing and see if you can slip through. Filing is always an option if you get sued.

All of these debts are killing me. I cant get a car loan without a co-signer. I cant even get a gas card. I really need to clear these debts some how. I cant consolidate then because i am not currently working. Not sure what you mean by SOL?? My car loan was not payed for since Oct, 2002.

The SOL is the length of time you can legally be sued.
Filing Bk will do nothing to improve your credit rating near term. You''ll likely still need a cosigner or, the interest rate will be at a nose bleed level. Plus, the student loans likely won't be discharged.
Look, the cc debt and the auto deficiency can sure be wiped out in bk. If you feel that's the best alternative, then do it.

Thank you! I am just trying to get rid of these debt, not looking to improve my credit. I will be able to improve it later after a bk right?

I have a credit report but i know there are things missing on it. I think there is like 3 or 4 credit report places yet i only have one. Most of the things listed are the most important ones. From what i knew i heard that bk is only on your credit for 6 years. Will i still be able to buy a home within the years of a bk? will be able to still quilify for 1st time buyers?

Are you talking about credit reporting agencies? If so there are 3 major ones: Equifax, Experian and TransUnion. You can go to their websites and order a report directly from them. If you don't have a credit or debit card you can always write to them and send them a check or money order.

What you heard about BK reporting is wrong. It will stay on your credit report for 10 years if you file Chapter 7. If you file for Chapter 13 it will stay on for 7.

You can purchase a home 1 day out of bankruptcy - But, you're not going to like the interest rates. You can generally qualify for a home 2 years after discharge if you've done work to reestablish your credit. I'm not sure about the 1st time buyers thing, but I don't think filing for BK should have any effect on it.
