My mom's debt....

My mom owes over $25,000 in Credit Card debt, I live with her and am also on the deed to the home which is paid off. My Grandmother died, and my mom used all the money that was left to her to purchase a home and pay off her car; at the time my mom was able to pay the minimum payment on each card.

Almost 2 years later, my mom had to apply for SSI due to being ill, and had to use the CC's to pay for Groceries, Medical Related Things and to pay Utility Bills at times; while she was waiting to see if she would be approved for SSI. That's how the $25,000 debt was accrued. She was eventually approved for SSI, over a Year and a Half later, and now only gets $564.00 a mo. I am on SSI also, due to being ill and get the same amount as my mom each month. The home has nothing owed on it, and the only source of income for each of us is each is our SSI.

My question is since the home is paid off and is co owned by me, could a creditor put a lien on the home and be sucessful? There are creditors calling day and night, when my mom answers the phone they tell her what a sad excuse and etc. of a person she is; and when I have answered a few times and I've told them I was her daughter they would proceed to tell me how my mom was scum of the earth, and much worse. We've quit answering the "Out of Area calls, but still end up answering some that may come from a City and State where we know someone, and it turns out to be the collectors.
 


Consider bankruptcy?

You might want to talk with an attorney regarding filing bankruptcy. Mississippi has a fairly liberal homestead exemption, and depending on how much your house is worth, may be completely exempt from BK. Your SSI benefits are also exempt so you may be able to clear these CC debts completely. Talk with a lawyer to be sure...
