In 1986 I was convicted of embezzlement. I was sentenced to 10 days community services, to pay back full restitution, was given credit for time served and place on 3 years probabtion. If I complied with all the stipulations my charge was suppose to be dropped to a misdemeanor. I did comply and I also paid an attorney to expunge my record. My questions is how do I obtain a copy of my record to see what is really there. My mother has a friend in law enforcement and he ran my name and it shows a felony. Is that correct? If not how do I go about fixing this? Any help will be greatly appreciated. Thank you.

See if you can obtain a written confirmation that your charge would be dropped to a misdemeanor. Remember, the court system is flooded with cases, you are not special over any one else. I don't say this to insult you, but merely to tell you you need to put your life in your hands and not just trust promises. Take initiative, go to the court with what you have and speak to the clerk about expungement steps. Let them know the judge stipulated in the court hearing that your charges were to be lowered based on this contingency. Show them you complied with the contingency and do not leave until you get some solid answers.

You may also, before you attempt to do this yourself, march down to your local legal aid foundation (found in the community guide section of your yellow pages under legal services)and ask the cirminal law division what you need to do.


Hope this helps. Take the law and learn from it. But remember, if you want something done right, you must do it yourself.
