My rights as a property owner

What is the name of your state?Texas
The property I own has a oil well and a tank battery with three tanks. The oil company hasn't used the pump jack in more then five years. Thay are only pumping water from the tank battery. I have the surface rights and no mineral rights.The oil company has an easment.Should I be receving revenue from the oil company for my surface rights?

**A: revenue from what? Water is not a mineral although it could contain minerals.

The sight that thay have had a pump jack on will not grow any thing but rocks.The soil is dead.Thay dug a sluge pit at that same sight,and since then a weed cant even grow.

Agreed. They are not allowed to damage the surface (within limits).
