My roomate got the landlord to take her name off our lease without telling me!

This situation has to do with my friend.

He came home to his apartment in Rochester, N.H. to find a note left by his roomate Lisa. She said that she had gone to the landlord and had taken her name off the lease as of that day 1/12/01. Both of their names were on the lease. She did not tell him of this prior to it. This note was all that he had. The landlord has since not contacted him to sort anything out or anything.

He needs to know what legal actions he can take. We are sure that he could sue her for breech of contract, but we do not know if anything needs to be done regarding the landlord. From our research it seems to be unlawful for the landlord to have broken the lease with one person without informing the other.

He is going to write the landlord and request a meeting to discuss this matter and see what her reasoning for allowing this is. It would be helpful to go into this meeting knowing if the landlord has broken any landlord/tenant laws

First off she did break the lease, so hopefully she paid this months rent.....

Second since she did break the lease the landlord must use her one months security toward next months rent, or untill your friend finds a roomate who will pay the landlord a months rent and a months security.

Other then that since her rent has been paid for this month and the security for FEB, your friend should find another place to live by March 1st,Or else he is liable for the FULL rent for March

If the landlord gave her back her security,Then HE screwed himself.......and then your friend has NO obligation to pay more then his half next month, and if he moves out by March 1st, he would still be entitled to get back his securty..

But the LL wont give it back, so he will have to sue him in small claims court.,
