my son got temporary custody of his 10 1/2 month old son on 8-02-01 because the mother's family came and told us that she was 16 weeks pregnant again by the guy she is now living with, they also told us that she is doing marijuana, cocaine, rolled esctasty , and air horns with my son's baby in the house. she admitted to the judge of giving cocaine to her minor sister. is there any possible way that a judge would give her back custody of my son's child? the judge ordered not contact with the child. does my son need to go ahead and file for permanent custody of his child and would he get it? please any information would help us out so that we can find out if we will always have him in a safe and drug free enviroment.

thank you

thank you so much.so you think that if we go ahead and file for pernament custody that my son would get it for his son and the mother cant get the baby back if we keep only the temporary custody papers or she can get the baby back?

i think that your chances are good. drugs and judges don't mix well at all.

however, i can't answer the part about her never getting custody back. there may come a time in her life, and i pray so, that she will straighten up her act. she may want visitation one day even. if i were a judge it would not be likely in her case, however, if she was clean for a long period of time and had proven that to me, i would consider visitation, supervised.

but sounds like that may be a long way off. she has to want to help herself first.
