My son wants to come back to live with me.

My son lived with me for 2 1/2 years. He asked to live with mom when summer started this year. I wrote and signed a letter saying he could. It was followed up with paperwork from her attorney, which I agreed with and we both signed. No court involvement. He lives with her and attends school in Wisconsin. He has been complaining about living conditions, neglect and verbal abuse. He called me last night asking to move back with me. I want him to a.s.a.p. I don't want him subject to any of it. I did contact the state about his complaints.

My question, can I use the same process that she used or do we have to go to court?

Most likely the paperwork was submitted to the court and became a court order. As for the neglect and verbal abuse, you need to prove it if mom fights to retain custody. If children services finds nothing, you are going to have issues in establishing anything happened. If children services finds something, then you will have to complete and be approved through an interstate compact. This is going to take time if mom does not agree. What type of neglect and verbal abuse is your son alleging?

It's worth checking - it may never have been filed.

But, even if it was filed with the court, OP asked if they could use the same process to change it. In all probability, they could. If ex would agree to the change, they can have it drafted by the attorneys and stipulated to the court.

LOL And this is the problem of just letting kids decide where they want to live.

And unless there is ACTUAL abuse/neglect, I'd tell the boy that he is staying until the end of the school year, at least.
