my son was hurt at school and nobody..

What is the name of your state? CA, public school

My son's ear was bleeding when I picked him up, and his shirt was torn and 2 buttons were missing. He said it happend at his last recess (2:00) I picked him up at 3:00. Nobody called me. This was Tuesday there was a substatute. I told his teacher how upset I was. I tried to speak with the principal, he was in a meeting. I spoke to the vice principal he said it sounded like my son had issues with being hyper and needed therapy. I went with him Thursday and today Friday. I noticed he is being treated differently then the rest of the kids. If someone says he did something, even if no teachers saw it, it must be the way the other kids say. Do I have a reason to file charges against school for not reporting bloody ear, ripped shirt? If so what charges? I am pulling him from the school. I am very upset at the poor care my son was recieving.
I took him to doctor right after picking him up. Doctor said he was either hit with something or pushed against something. She said this because the blood had splattered around his ear.

If the school believes that your child has some special needs, then it has an AFFIRMATIVE DUTY to evaluate him and give him the special education and services that his needs require.

They can't just label him a pain in the a-- and say that any problems that arise are his fault.

I would suggest that you get in contact with an attorney in your state who knows the federal and state protections that are in place for special education students. Don't just go to any attorney -- get one whose practice focuses on special ed law.

You can request due process and take the school to task for this incident and for others for its failure to identify, evaluate and educate your child properly.

That's going to be your best shot at getting some satisfaction from the school folks.....

I didn't mean to infer that he was special Ed. He was in a regular kinderarten class. He is not special ed.
Knowing this...should I still get an atty.?

What I'm trying to say, perhaps not very eloquently, is that if your child has the potential for some special services at school, that will help you get better treatment of him in terms of this current situation.

You argue that you believe your child has some special needs and needs to be evaluated as such. Then if there are some behavioral problems, the school has a duty to work to address those, not just say he's difficult.

That might go a long way toward solving your current issues and any future problems.

This doesn't mean he would be classified as a full-time special ed student -- only that they would address any needs he might have.

That would give him some special protections and extra care that he otherwise wouldn't get.
