I live in Tucson, Az. Last March my son accidentally bumped into a girl at school in the hallway, she turned toward him and began yelling and slapping him! He put his arm up in defense then walked away. He was then called to the Dean's office and told that the girl claimed he had bumped her, grabbed her breast and choked her, all at once apparently!!!! if that had happened, wouldn't the other students around have seen that? He ended up being suspended for 2 days but the disciplinary committee said he didn't grab her breast in a sexual manner because he is openly gay and has never shown an interest in girls-in so many words. The day he returned from suspension the girls 18 year old brother asked several people where to find my son then went up to him and put his hand on my son's left shoulder and threatened him. This left my son very scared! But the brother got off with a warning even though he didn't deny it!!! Fast forward to this past Saturday. We received a Petition filed in juvenile court that states my son 'knowingly and recklessly caused injury' to the girl and he has a court date on 09/27/17 @ 10am! They attend the same small school together still though my son has never uttered a word to her but today had to walk the same halls she does! Needless to say he was extremely worried this morning! I have copies of three texts that she sent to a friend when it all happened last March and she actually states something different happened! The only downfall it that they don't have her name or phone number on them!!! But hopefully the friend will come forward and state they are from her?!?!? I have an appt with an attorney tomorrow at 4pm. What should I bring, what should I ask and tell him? I have every email between me and the school, all court papers, the three texts and notes i wrote going through everything last March. The Dean said she will even give me the emails between the brothers father and her where he acknowledges what his son did. She suggested we go after the brother in hopes that they will drop the case against my son but I don't know if the DA will still push it through? Please help me!!!!
