Getting the money out of her if she improperly took it is civil.

Depending upon just what she did and what the business and her role in it are, there may not be any criminality involved if that is what your asking. Even if it was criminal, the state may be unable to prove or disinclined to try to prosecute. Prosecution doesn't mean you'll get the money back either.

All this will be settled out in the divorce.
