my wife is falsly accused of assault

my wife was assaulted by my ex-wife on the 29th of august. we called the police and filed assault and battery against her. after my ex-wife was arained she filed assault against my wife. my wife did hit her but in self defence my ex-wife was sitting on her hitting her and my wife had to hit her to get her off. the ex didnt file until 4 days after the assault. is there a time limit on how long after an assault you can fileand if my wife is found not guilty can the judge remove the arrest from her record as it was clean before this and she has done nothing to have an assault on it?we live in virginia and cant get any answers from anyone. please help

You can file assult charges anytime you want.. up to a certain point of course, but 4 days are well withing any SOL. I suggest your wife also gets a TRO. Were there any other witnesses?
