Mediation did not go well we are at oppostie ends of the spectrum he wants joint physical split her up in two houses I ask for sole physical with reasonable visitation.Keep in mind we have never lived together and I have taken care of all mychilds expenses medical clothing daycare etc. He contibutes when he feels like it and how much he feels like it. I have filed for custody(sole) vistation and support. He didcided to bring this into court we had an agreemnet every other weekend no overnight but all day both days on that weekend and a visitation during the week also,he was not satisfied so off to court he ran now we are in the system,quite frankly he is not doing this for the love of the child but to get back at me because he is a loser and cannot admit to it he has never done right by our child thank god I saw through the b.s. before marriage came to pass. So in a few weeks we are off to the judge for a hearing to start the process. Does any one have any helpful ideas what might go on......

he is asking for joint physical and you want sole.

can there be an inbetween spot? how about joint legal and you with physical or custodial? because to be honest, unless he is abusive or there is something from his past that we are not aware of. that will probably be the recommendation of the judge.

over nights. if the child is familiar with him and there is nothing in his past to show that he is abusive or a danger to the child - he will probably receive the usual every other weekend and holidays. this will include overnights.

on the first page, there is an idex that you can go to. click on it and on the index click on types of custody. that explains it out really well, what each type is and the pros and cons for each. the lawyer that wrote it is not a big fan for split physical custody (neither am i) because it is to hard on the children. you might find it useful information.
 
There are things that are not really in the past actually they are so recent that it scares me to think they might get ignored I don"t want to go truely into it because you never know who might be reading......But I can say his morals are questionable he is a drinker and other things along that line and it won't be a he said she said statment also he repeatly does not put the child best interest first. I would like to say more if you want to talk to me directly give me an e-mail to speak to you..

you know the basics of the case better than anyone else.

without something that would endanger the children, or criminal charges, etc. he could possibly receive joint custody and regular visitation rights.

if you are able to substantiate that the children could be in harms way if they were allowed the visitation then you would stand a better chance at restriction his visitation.

not without it though.
