N.J. NCP refusing to work full time .Cash business

My ex boyfriend is refusing to work a forty hour week claiming the work doesn't give him a forty hour week> It runs any where from 10 hour to 60 depending on the season. But I also know because I have gone with him he refusing to work his on the books job to work side work since it is cash in hand> I know that last year he refused to work often,so he only made 17,000 last year but for the year 1999 he made 35,000 . Also he is purposely not working now but on a month vacation somewhere but close enough to come home for a two hour visit on his day and return to his vacaion spot with his girlfriend. My lawyere doesn't seem to want to pursue the cash issue he just say they will go by his income. But in the past six months since we have split he has spent problaly close to 15 or 20 thousand in luxury items for himself. His contribution doesn't even cover half her daycare expense so you know he isn't even covering his percentage of her living expense either. So how do I prove the cash issue and how do I get his past income tax reports in also? Or any other suggetsions?

I believe in a situation like that, you can have him evaluated for what he is <i>capable</i> of making, rather than what he is actually making. I think (not positive) you can ask to have his past 3 years of income evaluated. That should show that this year's income is "incorrect." You might remind your attorney that you are paying him to FIGHT for you and your child, not sit by complacently!!
 
I have tried to say that politely and he is changes his attitude like the wind blowing I have watch him treat me like with kid gloves and the next breath snotty. I have a few days before court I was planning on dropping him a note and reminding him that he works for me If I have to pay him then he needs to listen a bit better yes he knows the law,and I need his advice but I don't know if he will impute a wage on him because the lawyer plays weather he will address the cash thing or not. Frankly it is a damn shame that if it is not addressed my ex will be getting away with murdere. I could care less if the cash was on top of a forty hour week thenyea that should be his,but when you are refusing to work forty hour week,scamming all the way , that is wrong !!!!!!!!!!!!!!!!!!
