name change after termination of rights ?

after reading what jaw043 said about changing her sons last name, it got me interested again in changing my daughters. Now according to my lawyer you can only change a child's name within a year of birth and get a NEW birth certificate...but if you wait after a year you get a different one with the new name and you also have to keep the original. Now here's my deal .... he terminated his rights August 16th, 2006, about 8 months ago, but the papers that I filled out say that they'll need to get his okay... now since he terminated his rights, will they still need to get his okay ? because i know he wouldn't agree to it ! (He thinks even though he terminated his rights that her having his last name means that he's still a father to her.....weird!?)

Was the father's rights terminated in a court order?

If they were, just attach a cerified copy of the order to your name change petition.

If there is no court order of termination, you will need his permission.

yes we signed papers and they were signed by a judge. thats what i figured is I wouldn't need to have his permission .. but you never know !
