What is the name of your state (only U.S. law)? new york

How can i have my name put on my child's birth certificate my name is not the certificate its blank. I recently got physical custody of her and I want her to have my last name she has her mothers. She was born in La.

You can petition the court to ADD your name to mom's (hyphenate), it is unlikely they will approve CHANGING the name fully. Mom is still mom and you can't erase her from existence.

i must politely disagree only b/c in NYS, with a court order the name can be changed to whatever the petitioner is asking {assuming the order is granted} my husband is an example.

His ex put ANOTHER man's name as the father on the B/C. my husband had to get a DNA test, order of filiation etc, he had to take it to the health dept first to show proof he was the father and they changed his sons last name completely to just his last name only. there is no law in NY that i am aware of that states that both names have to be used{could be wrong, dont quote me on this}

BUT....how old is the child? i wouldnt change the name only for the childs sake, the child is used to a certain name and is already going thru a lot it seems with the custody change.

love your child more than you hate the ex, wise words from another member on here....

Liandrajade she is 12 years old. There is no animosity between the mother and I she agrees with changing the name and my daughter always asks why her last name is different then her other siblings. She wants to change her her last name. Both names do not have to be on the certificate if changed. Would I still have to petition here in NY since she was born in a different state though?

call the office of vital records in the state she was born. Each one has different regulations. I know in Alabama, all we had to send was the court order granting custody to dad (the court order did say he was the father) and they changed it.

Where she was born doesn't matter. Neither does the state you live in. What matters is the state which holds jurisdiction. Are there already orders regarding the child? Does either parent still live in that state? If the answer to either question is no, then the state where the child is a resident is the one which matters.

I didn't know that birth certificates swiched states based on residency. We lived in Tn, but she was born in Alabama and they are the ones who changed the birth cert and sent us the new one.

Placing the father's name on the BC doesn't change the child's name. That needs to go through the courts.

Yep, I was focused on the name change. Though I don't know why OP didn't bother to address these two issues when he got custody.
