I am suing a small corporation for un-paid commissions. Do I name the registered agent as the defendant and/or the corporation? JWLage - Illinois

My response:

You name the corporation, and the person responsible for paying your commissions, only. The agent is only a person (usually an attorney) who is appointed by the corporation to receive Service of Process on behalf of the corporation.

Style your lawsuit like:

ABC Corporation
Bob Smith, Agent for Service
123 Mail Street
Anytown, USA 00000

(The address shown should be the one shown for the Agent for Service, not the Corporation)
