I was sued by my former inlaws when I divorced from their son in 1998 in California. They had helped us get a home in 1986, putting down 30,000 with their name on the deed and mortgage. In 1996 they signed the deed of the house over to my former husband and I and said on the deed this was a gift from parent to child. They also verbally told us that when we ever sold the house they wanted their 30,000 back. Well when I divorced their son that is exactly what I put in the divorce papers, that the house is to be sold, and 30,000 is to go to my inlaws. Well as a revenge on me thaey brought a lawsuit against both me and their son(they had to put his name on it, but they were'nt touching him they were just making sure I did not get a penny of the money from the house.) The suit was for over 100,000. Bottom line after a year of hell back and forth with my lawyer and theirs we sat down in my lawyers office with their lawyer present and they wrote me a check for my end of the house if it had been sold, in otherwords bought me out. In the office that evening we all signed a paper stating that the lawsuit was over and that they were to have my name and all obligations removed from the house. I signed and noterized a deed transfer to exhusband. Now it has been over a year since this took place in my lawyers office and I have a copy of what we all signed, but they have not made any effort to remove my name and obligation to this house. I have since remarried, moved to Washington and have no contact with ex or his parents. What can I do. I may need to qualify for a new home , but thiss old house is still showing on my credit reports. Please let me know if what we all signed in my lawyers office is binding and are they in breach on contract if they have not taken me off . Also there was not a time limit set, is that probelm for me ???? I don't want to have to pay anymore money for a lawyer if I can avoid this, can I take them to small claims for breach of contract? They are still in calif and I'm here in Wa does this pose a problem???
