What is the name of your state? Maryland
What should I do at thei point? I have a small debt $117 on my credit report. Last activity was in 1999 or possibly 1998. NCO is listed there with the same debt and they re-dated it to 2002 back in the SOL
It's not like I don't want to pay my bills its just that there is only enough money to keep houshold bills current. As far as I know they have not contacted me. I contacted the OC and they said that they don't even have a record of me anymore and they purge after every so many years.
What could be my course of action at this point I understand that this will still apear on my credit report but for only as long as it is legally supposed to be there?

I think that 2002 may have been when NCO got the debt. Did some checking and the DOLA is Nov of 1998. As far as I know NCO has not attempted to contact me. Should I write to the CRA and dispute? The only records I have from this debt have been lost as I was leaving a domestic violence situation and all I have is what the OC has said. The OC has it also on my report and listed as 1999 still out of SOL. Talked with the OC and the account is so old they really don't have much on record about it.
I just don't want NCO havin my new adress because I don't want the harassment if they find me as my CR does not have my current one on there jsut my address of record for the military. I have also not moved from the state of Maryland for a long time 30 years as I only spent 6 months in Illinois for training but allways used MD as an adress. So there is not a possibility of a suspended SOL for Maryland. This is a debt with an electric company in Maryland and there is no charge off date listed on my CR even though I know the DOLA has been at least 6 years ago. The SOL in MD is 3 years. The accounts are also listed as open. There is the OC and NCO and also listed as NCO-Marlin and Marlin Intigrated CA adn all accounts are listed as open and there is no charge off either on any of them except for one that lists a CO in OCT of 2002 wich is the same dade that NCO has listed. Are they attempting to use the charge off date as a DOLA? They also have this debt listed on my Equifax report as at least 120 days or more that 4 payments past due. I don't think that they can do that.
I did read a thread in another forum(credit info center) about the OC also being responsable for the actions of the CA(was that you? :) ) Should I dispute this first and then file an FTC complaint or just go ahead and contact the FTC now. These people have been punished for what they have done to me and I don't feel that they should be able to get away with this.
Thank you so much for all your help you are one awesome gal! :)

NCO-Marlin and Marlin Intigrated --- ALL the same company = NCO.

The new FACT Act now apparently requires that tradelines include the 'date of first delinquency', that is the actual date that would be used to figure SOL AND the start of the reporting period. I have yet to study the full FACT Act, guess I"d better get on the ball :) You can now dispute that date if its left blank, n/a, or just plain wrong. There was no prior requirement that this date be on your reports at all, a big hole that apparently has been plugged.

DOLA is NOT the charge-off date, so if NCO is reporting it that way, its WRONG.

If you're the one on CIC asking for a list of states where creditors are held accountable by state law for FDCPA violations, I DID post a list of states there this morning :D

Not on that board but lurking! Will check that out :) The funny thing is the lady at the OC (very helpful) is having problems with NCO as well as they are going after her for a debt the is not hers LOL!! I thought it funny that they are showing a charge off date and a DOLA in the same month and year. She told me that the service was terminated in Nov of 1998 and I made no payments or had any contact with them my self or on my behalf (land lord turned the service off) since then.
Also one of the listings does not even show a date. Seems that I may have a laundry list of violations to report :D
If ths helps I pulled this credit report on 3/12/05 with the date on the computer print out. Going to save this in case I need it later ;)
